Swarthmore College Professor of Political Science Carol Nackenoff, an authority on American politics and the author of Oxford Bibliography's guide to the Supreme Court, is available for comment on today's Supreme Court ruling on the Fair Housing Act. Nackenoff’s initial thoughts on today’s ruling: “The decision is really important because disparate impact analysis has been largely discredited by the Supreme Court as a way to get at discrimination in recent years. It is a lesser burden of proof than discriminatory intent, which is really hard to prove. It places more responsibility on the entity charged with discrimination to show why their practices are at least reasonable.”
