Cornell Professor says lawsuit is overdue against the architects of the CIA detention and interrogation program

Joseph Margulies, Professor of Law and Visiting Professor of Government at Cornell University, and Counsel of Record in Rasul v. Bush (2004), involving detentions at the Guantánamo Bay Naval Station, believes the litigation being brought by former prisoners James Mitchell and Bruce Jessen against the creators of the CIA’s detention and interrogation program is long overdue.

Margulies says:“It is the first suit against the architects of the Bush Administration torture program, the first litigation in the wake of the massive torture report by the Senate Select Committee on Intelligence, and the first test of whether the Obama Administration will hide behind the State Secrets doctrine in an attempt to block the litigation, even after officially acknowledging the program.

“The defendants in this litigation, James Mitchell and Bruce Jessen, continue to defend their role, and it is long past time their defense was put to the test in open court.”
