EEOC Ruling Correct, But Ineffective

A recent Supreme Court ruling giving the Equal Employment Opportunity Commission (EEOC) the ability to seek money or other damages in court for employees who have signed away their own rights to sue will not have much affect on employers or employees, says UAB management professor Susan Key, Ph.D., J.D. "Though this is the correct ruling -- what an employee signs has no effect on the EEOC -- it doesn't affect most employers because the EEOC files suit in few cases, less than 1 percent of complaints. They just don't have the resources to do more." Also, don't look for this to affect the use of arbitration agreements. "The ruling does nothing to harm them."
