Michael Dorf, constitutional law expert and professor of law at Cornell University, discusses House Speaker John Boehner’s opposition to the Employment Non-Discrimination Act that is designed to ban discrimination in the workplace on the basis of sexual orientation.

Dorf says:

“Speaker Boehner's explanation for his opposition to giving LGBT Americans the same protection from discrimination that everyone else enjoys fails the laugh test. His spokesman says that the proposed law would ‘increase frivolous litigation and cost American jobs.’

“By that logic, existing legal protections against discrimination based on race, religion and sex are also unwarranted invitations to frivolous litigation. Accordingly, one can only conclude that Speaker Boehner and the GOP more generally are really seeking to placate the socially conservative far right, even as a clear majority of Americans support full workplace equality.”
