When You Lose More Than Your Job

Workers can lose more than their jobs when they are laid off or the company closes, says UAB management professor and human resource management expert George Munchus, Ph.D. Workers may find themselves without final paychecks, accrued vacation pay or key documents like W-2 forms. "The best advice to an employee, if they cannot get any of these things from a failed company, is to retain a lawyer who specializes in employment law and who represents employees 75 percent of the time. Let your lawyer speak for you. Another good rule of thumb is to hold on to pay stubs each year. That could at least help with the W-2 issue. But as for a final paycheck, it's often difficult to get them so a lawyer is your best bet."
